Notice of Arbitration Agreement: These Terms include an Arbitration Agreement that may impact your right to use courts to resolve disputes. Please review Section 18 below. If you do not wish to be bound by it, do not use the Site.

1. Acceptance of Terms

By using healthadvantageplan.com(the “Site”), submitting your information, providing your phone number, clicking “Next,” “Submit,” checking a consent box, or taking a similar affirmative action, you accept and agree to these Terms of Use as applied to your use of the Site. If you do not agree, do not access or otherwise use the Site. We may change these Terms at any time by posting the changes here; continued use after a change means you accept the update.

2. Eligibility

You may only use the Site if you are domiciled in the United States and are at least 18 years of age.

3. Not Medical, Legal, or Financial Advice

Content on this Site is for general educational purposes only and is not medical, legal, tax, or financial advice, and does not constitute a recommendation to enroll in any specific plan. Medicare rules, costs, and plan availability change regularly and can vary by location — always confirm current details with a licensed agent, the plan carrier, Medicare.gov, or 1-800-MEDICARE before making a decision.

4. Non-Government Site

Health Advantage Plan is a non-government entity. This site is not connected with or endorsed by the U.S. Government or the federal Medicare program.

5. Not All Plans Offered

We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options.

6. Services Available on the Site

Through the Site, we provide a service by which consumers can request information and connect with licensed insurance agents, brokers, and other service providers regarding Medicare Advantage, Medicare Supplement, and Medicare Part D plans (the “Services”). We seek to provide information you can use to make your own decisions. Once you submit an inquiry, we attempt to connect you with an appropriate licensed agent.

We do not issue insurance contracts or bind coverage. We do not endorse or recommend any specific company or policy, and we do not provide insurance, tax, or financial advice. We do not guarantee that any agent we connect you with will contact you or offer you coverage, and we are not responsible for the conduct of the licensed agents you are connected with. We may change, suspend, or discontinue any part of the Site or Services at any time, without notice. There is no charge to you for use of the Site.

7. How We Make Money

Health Advantage Plan is an independent, advertising-supported site that helps connect individuals with licensed insurance agents. We may be compensated by agent partners for inquiries, calls, or connections generated through the Site. This compensation may impact how, where, and in what order information appears. We do not include every plan or every company available in your area, and Health Advantage Plan is not itself a broker or agent on the sale of insurance products.

8. Proprietary Rights

As between you and Health Advantage Plan, we own all right, title, and interest in the Site, its content, code, design, and the compilation of materials on it. Using the Site does not grant you ownership of any content, code, or materials you access. You may view the Site and make single copies of its content for your own personal, non-commercial use only. You may not otherwise copy, reproduce, distribute, or commercially exploit any content, code, or materials from the Site without our prior written permission. We do not grant any license to our trade names, trademarks, or logos without a separate written agreement.

9. User Submissions

In the course of using the Site, you may provide information to us — such as through our lead form (“User Submissions”). Our information collection and use practices are described in our Privacy Policy, which is incorporated into these Terms by reference. You are solely responsible for the accuracy of your User Submissions. We may delete or decline to act on any User Submission at our discretion.

10. Session Data & Tracking Technologies

While you use the Site, we and our service providers may record your interaction with the Site using session and consent-verification technologies (such as TrustedForm or Jornaya) and standard analytics and advertising platforms (such as Google and Meta) for analytics, optimization, and TCPA consent documentation purposes. You agree these providers may record your use of the Site as described in our Privacy Policy.

11. User Conduct

You agree not to use the Site to upload or transmit unlawful, threatening, harassing, defamatory, or fraudulent content; impersonate any person or entity; harvest data or email addresses; scrape, spider, or attempt to obtain lists of other users; or attempt to gain unauthorized access to our systems. You agree not to use the Site in any way that could damage, disable, or overburden it, or interfere with other users' access. You agree to defend and indemnify Health Advantage Plan against claims arising from your misuse of the Site or violation of these Terms.

12. Prior Express Written Consent (TCPA)

By providing your phone number and clicking “Next,” “Submit,” checking a consent box, or taking a similar affirmative action, you are giving your electronic signature and providing prior express written consent authorizing Health Advantage Plan and its authorized agents, representatives, and service providers acting on our behalf to contact you for marketing and informational purposes. This may include calls, prerecorded messages, text messages, and emails using an automatic telephone dialing system (ATDS), automated system, or other automated technology — even if your number is on a Do Not Call registry.

Your consent is not required as a condition of purchase. By providing your contact information, you confirm you are the subscriber to, or customary user of, the phone number and email address provided. You may withdraw consent at any time as described in Section 15.

13. Electronic Records & Signature

By taking the affirmative actions described in Section 12, you confirm that you have the authority to provide prior express written consent and agree to the use of an electronic record to document this consent. That action serves as your valid electronic signature under applicable federal and state law.

14. SMS/Text Messaging Program

If you opt in to receive text messages from Health Advantage Plan, we may send responses to service inquiries, follow-up messages, and, where separately authorized, marketing or informational messages related to Medicare Advantage, Part D, and Medicare Supplement plans. Message frequency varies; message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

To stop receiving text messages, reply STOP to any message you receive from us. For assistance, reply HELP or call (302) 407-0876. Your opt-out request may generate a confirmation text; please provide any requested clarification to complete your opt-out.

15. Accessing & Withdrawing Your Consent

You have the right to request a free copy of your prior express written consent, or to withdraw that consent at any time, by calling (302) 407-0876 or emailing info@healthadvantageplan.com. See also our Do Not Call Policy.

16. State-Specific Information

California residents: may have rights to request access to, correction of, or deletion of their personal information, and to opt out of the sale or sharing of personal information. See our CCPA Notice.

Florida residents: may opt out of further communications under the Florida Do Not Call Act by contacting us using the information in Section 20.

Nevada residents: may request to opt out of the sale of certain covered information by contacting us using the information in Section 20.

17. Use License

You may view and use the content on this Site for your own personal, non-commercial use. You may not republish, sell, rent, or otherwise exploit content from this Site without our prior written permission.

18. Dispute Resolution: Binding Arbitration & Class Action Waiver

Agreement to Arbitrate. You and Health Advantage Plan agree that any dispute arising out of or relating to your use of or access to the Site or Services shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may bring an individual claim in small claims court if it qualifies. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Class Action Waiver. You and Health Advantage Planagree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Procedures. Arbitration will be administered by the American Arbitration Association (“AAA”) under its rules, including its Supplementary Procedures for Consumer-Related Disputes where applicable, and held in the county where you reside or another mutually agreed location. If the relief sought is $10,000 or less, either party may elect to proceed by telephone or on written submissions alone. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

Costs. Payment of filing, administration, and arbitrator fees is governed by the AAA's rules. If the relief you seek is $10,000 or less, we will pay these fees at your request unless the arbitrator finds your claim frivolous. This provision survives termination of these Terms and your use of the Site.

Severability. If a court or arbitrator finds the Class Action Waiver above unenforceable, then this entire arbitration section is void, and disputes will proceed in court as described in Section 21. If any other part of this section is found unenforceable, the rest of this section still applies.

19. Disclaimer of Warranties

The site and all services, content, and materials are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, uninterrupted access, title, non-infringement, merchantability, or fitness for a particular purpose. We do not warrant that the site will be timely, secure, or error-free, or that defects will be corrected. If you are dissatisfied with the site, your sole remedy is to stop using it.

20. Limitation of Liability

To the fullest extent permitted by law, Health Advantage Plan and its directors, officers, employees, and agents are not liable for any indirect, incidental, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the site — including lost revenue or lost business — even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

21. Third-Party Links

This Site may link to third-party websites, including Medicare.gov and insurance carrier sites. We do not author, edit, or monitor these sites and are not responsible for their content, accuracy, or privacy practices.

22. Governing Law & Miscellaneous

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, and (subject to Section 18) you agree to the personal and exclusive jurisdiction of the courts located in Delaware. Our failure to enforce any provision of these Terms is not a waiver of that provision. If a court finds any provision invalid, the remaining provisions continue in full force and effect.

23. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
